California Finalizes Special Provisions for Hosted Platform and Infrastructure Services

The Department of General Services has completed and released model contract provisions for infrastructure-as-a-service (IaaS) and platform-as-a-service (PaaS) cloud computing agreements.

The Department of General Services has completed and released model contract provisions for infrastructure-as-a-service (IaaS) and platform-as-a-service (PaaS) cloud computing agreements.

The special provisions identify standards for data ownership and protection, data location, security incident notification, data storage and retrieval, and a several other factors specific to "as a service" offerings.

The special provisions will apply to any contracts entered into on May 13 or thereafter, DGS explained, and will be accompanied by a Statement of Work that includes more specifics and requirements.

DGS sought input on the special provisions from the IT supplier community during an April 22 forum at DGS headquarters in West Sacramento. An archived webcast of the event is available.

The group discussed issues surrounding IT contractors and resellers. There are only a few differences between the special provisions for IaaS and PaaS.

Until now, the special provisions for cloud computing only were available for software as a service (SaaS). The document was initially released in September 2014.

As of late 2015, approximately 1,000 firms had signed the state’s special provisions for cloud, through the California Multiple Award Schedule (CMAS) program and the Software Licensing Program (SLP).

"The State Model Cloud Computing Services Special Provisions (IaaS and PaaS) shall be used in conjunction with the state’s General Provisions – Information  Technology (GSPD-401IT). The State Model  Cloud Computing  Services Special  Provisions (IaaS  and  PaaS) were created from templates developed by the Center for Digital Government and with input from the information technology community and state departments," DGS announced in a May 11 bulletin.
